Terms and Conditions
1. About These Terms
These Terms and Conditions apply to your use of www.re-ambition.com and the products and services provided by ReAmbition (Pty) Ltd (“we”, “us” or “our”).
Please read these terms before purchasing a product or booking a service. You must be at least 18 years old to purchase products or engage our services.
For paid services, these terms apply alongside the written scope, quotation or Statement of Work agreed with you.
Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded or limited under South African law.
2. Our Products and Services
ReAmbition provides:
- Business Workflow Reviews.
- Separately agreed implementation services, including practical process improvements, simple automation and small custom Windows applications.
- Ready-made software applications.
- Downloadable personal development resources, including books, guides and mindfulness recordings.
The relevant product page or written service agreement describes what is included.
We may change or discontinue offerings. This does not remove our obligations under purchases or service agreements already accepted.
3. Workflow Reviews
Discovery and agreed scope
The free discovery call helps us understand your needs and decide whether ReAmbition is the right fit. It does not commit either party to a paid review or implementation work.
Before you book a paid review, we will confirm in writing the workflow to be reviewed, the fee, what is included and when you can expect the written report.
What the review includes
A Workflow Review examines one agreed business workflow to identify unnecessary work, delays and practical opportunities for improvement. It includes a review session and a written report with findings, recommendations and suggested next steps.
The review is limited to the agreed scope. It does not cover every process or system in your business.
Software and technical support
We may discuss the software you use to understand how your workflow operates. This does not mean that we provide specialist support for that software.
The review does not include software setup, configuration, troubleshooting, training, integrations or software development. Any such work requires a separate written agreement and will only be accepted where it falls within our capabilities.
These exclusions do not replace the support commitments provided with ReAmbition’s own software products.
Information and findings
You agree to provide accurate and reasonably complete information about the workflow being reviewed. Our findings will be based on the information made available to us.
Where a recommendation depends on further technical investigation or specialist advice, we will identify this. Estimates of potential savings or improvements are not guaranteed results.
4. Implementation Services
You may implement the recommendations yourself or use another provider. Purchasing a review does not commit you to further work with ReAmbition or commit us to implementing every recommendation.
If you ask us to assist, we will first confirm whether we can take on the work.
Implementation requires a separately approved Statement of Work covering the scope, deliverables, fees, timing and responsibilities. Work begins only once this has been approved.
Any changes to the scope, fees or timing must be agreed in writing before the additional or changed work begins.
5. Service Cancellations and Rescheduling
How to notify us
To cancel or reschedule a service, email rob@re-ambition.com as soon as possible.
Free discovery calls carry no cancellation fee.
Paid Workflow Reviews
You may cancel or reschedule a review session without an appointment cancellation fee by giving at least 24 hours’ notice before the scheduled start time.
If you cancel with less than 24 hours’ notice or miss the appointment, a reasonable cancellation charge may apply. We will consider the notice given, the nature of the booking and whether we could reasonably fill the appointment. We will explain any charge rather than automatically retaining the full review fee.
If you cancel the review after agreed work has already been completed, you may be charged for that work at the agreed rate or a fair proportion of the agreed fee. We will not charge twice for the same work or loss.
Any remaining prepaid amount will be refunded, subject to your applicable statutory rights.
Implementation projects
Cancellation arrangements for implementation work will be set out in the Statement of Work before work begins. These will explain how completed work, approved commitments and any unused advance payments will be handled.
If we need to cancel
If we need to cancel a review session, you may choose a new appointment or cancel the review and receive a refund of the review fee.
If we discover that we cannot complete an agreed service, we will notify you promptly and explain the position. We will refund amounts paid for work we cannot deliver, without limiting any other remedy available to you under applicable law.
Statutory cancellation rights
This policy does not override any applicable cooling-off right or right to cancel without a charge. Where section 17 of the Consumer Protection Act applies, no cancellation fee will be imposed if the booking cannot be honoured because of the death or hospitalisation of the person for whom it was made.
6. Prices, Payments and Delivery
You are responsible for providing accurate contact and payment information.
Payments for products purchased through our website are processed through a third-party payment gateway. The payment provider’s applicable terms also apply.
Service fees and payment arrangements will be confirmed in the written booking details, quotation or Statement of Work before you commit.
Downloadable products and software
Once payment is confirmed, you will receive a download link or access instructions. Technical difficulties may occasionally delay access.
If you have difficulty accessing your purchase, contact rob@re-ambition.com.
Purchases through other websites
Some products may be purchased through third-party websites such as Amazon. Purchases completed through those websites are subject to the relevant seller’s terms, payment arrangements and delivery procedures.
7. Product Refunds and Problems
Change of mind
Unless the product page offers a more generous policy, we do not offer discretionary change-of-mind refunds once a digital product or software download has been supplied.
This does not affect any cancellation or refund right available under applicable law. Providing a download link does not, by itself, remove your statutory rights.
Problems with a purchase
If your purchase is inaccessible, defective or materially different from its description, contact rob@re-ambition.com with your order details and a description of the problem.
We will investigate and provide an appropriate remedy in accordance with applicable law. Depending on the circumstances, this may include restoring access, correcting the problem, replacing the product or providing a refund. Where the law gives you a choice of remedy, that choice remains yours.
The 30-day technical assistance offer in section 8 does not shorten any statutory period for reporting defects or seeking a remedy.
Service cancellations and rescheduling are covered in section 5. Purchases from third-party sellers should be raised with the relevant seller under its procedures and applicable law.
8. Software Requirements and Technical Assistance
System requirements
Check the system requirements on the relevant product page before purchasing. You are responsible for having compatible equipment and any software needed to access the product.
Our desktop applications are intended for Windows. The supported Windows versions and any additional requirements are stated on the product page.
Included assistance
We provide installation instructions with our software.
For 30 days after purchase, you may contact rob@re-ambition.com for reasonable assistance with installation and initial use of the purchased product on a system meeting its stated requirements.
This assistance covers our product. It does not include general computer repairs, support for unrelated software, network administration, custom development or changes to the product’s advertised features.
Any additional work must be separately agreed before charges are incurred. These support boundaries do not limit our obligations to address defects or other failures for which you have a remedy under applicable law.
Security warnings
Your operating system or antivirus software may display a warning during installation. Do not assume that every warning is harmless or disable security protections simply to run the application.
If you are unsure, contact us with the warning details before proceeding.
9. Data Storage and Backups
Our desktop applications store their operational data locally on your device, as described in the product documentation.
You are responsible for protecting your device and maintaining current, separate backups of important data. You must periodically check that your backups can be restored. Keep a recoverable copy that will not be lost if the working files are deleted, overwritten or corrupted.
Before installing updates, moving application files or making changes that could affect your data, create a current backup. This also applies before any separately agreed implementation work involving your systems or data.
Cloud synchronisation, including OneDrive, is not by itself a reliable backup because changes or deletions may also be synchronised.
Unless expressly agreed in writing, ReAmbition does not manage, monitor or verify your backups or provide data recovery services.
Where legally permitted, we are not responsible for loss to the extent that it was caused or increased by your failure to maintain suitable, recoverable backups or follow reasonable instructions. This does not exclude liability that cannot legally be excluded. Section 13 also applies.
10. Intellectual Property and Licensing
Our products and software are protected by intellectual property laws. Ownership remains with ReAmbition or the relevant rights holder.
Personal development resources
Purchasing an eBook, recording or other personal development resource gives you a limited, non-exclusive, non-transferable licence for personal, non-commercial use.
You may not redistribute, resell or publish the resource without written permission, except where applicable law permits otherwise.
Ready-made software
Unless the product page expressly provides a different licence, purchasing a desktop application gives you a limited, non-exclusive, non-transferable licence for one user to use it on compatible devices for internal personal or business purposes.
The licence does not permit sharing the software between multiple users or renting, leasing, reselling, distributing or sublicensing it.
Except where permitted by applicable law or authorised in writing, you may not modify, decompile, disassemble, reverse engineer or attempt to derive the software’s source code.
Custom work
The Statement of Work will specify ownership and usage rights for custom deliverables, including any existing ReAmbition components or third-party materials used in the project.
11. Health and Wellness Resources
Our personal development and wellness resources are intended for educational and informational purposes. They do not replace professional medical, psychological or mental health care.
ReAmbition does not diagnose, treat, prevent or cure physical, mental or emotional conditions.
Consult a qualified healthcare professional about health concerns. Do not use our resources as a reason to delay or replace professional care.
12. Confidentiality and Personal Information
Confidential information
Each party will protect confidential information received from the other and use it only for the agreed work.
This obligation does not apply to information that is already lawfully known to the receiving party, becomes public without a breach of confidentiality, is independently developed or is lawfully received from another source without a confidentiality restriction.
Confidential information may be disclosed where required by law. Where legally permitted, the receiving party will notify the other party before disclosure.
Before sharing your confidential information with an external provider for the agreed work, we will obtain your written authorisation and ensure appropriate confidentiality arrangements are in place. Authorisation may be recorded in the Statement of Work.
Personal information
We handle personal information in accordance with applicable data protection law and our Privacy Policy.
Please provide only the information reasonably needed for the work. Where practical, use sample or anonymised records instead of live customer or employee information.
Where we process personal information on your behalf, we will agree the necessary instructions, responsibilities and security arrangements in writing before that processing begins.
13. Responsibility and Limits of Liability
This section limits certain claims against ReAmbition. Please read it before purchasing a product or booking a service.
Our responsibilities
We will provide services with reasonable care and skill and in accordance with the agreed scope. Our products must meet their descriptions and any applicable legal quality requirements.
We do not promise particular financial results, time savings or business outcomes unless expressly agreed in writing. Software may require corrections or updates; this does not remove your rights if a product is defective.
Losses outside our responsibility
We are not responsible for loss to the extent that it is caused by your misuse of a product, unauthorised changes or failure to follow reasonable instructions, rather than by a failure for which we are responsible.
Where legally permitted, we exclude liability for indirect or consequential losses. This exclusion does not automatically treat every loss of income, profit or data as indirect.
Financial limit
Subject to the exceptions below, and only where lawful and fair in the circumstances, our total liability for damages arising from a particular product purchase or service engagement is limited to the total fee paid or payable for that purchase or engagement.
For services, the relevant engagement is the Workflow Review or the implementation project identified in the agreed Statement of Work.
This limit does not reduce any refund, repair, replacement, repeat performance or other statutory remedy to which you are entitled.
Exceptions
The exclusions and financial limit in this section do not apply to fraud, wilful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited.
Nothing in these terms requires you to give up a non-excludable consumer right.
14. Governing Law
These terms are governed by the laws of the Republic of South Africa. Disputes are subject to the jurisdiction of South African courts, without limiting any applicable statutory complaint or dispute-resolution rights.
15. Changes to These Terms
We may update these terms by publishing a revised version on our website.
Updates apply to future purchases and bookings. They do not retrospectively change an existing purchase or agreed service unless we agree the change with you or a change is required by law.
